Rates for the year 2019 – 2020, and from 2020 – 2021 are included in this agreement; as of the rates from 2022 and the consecutive years, they will be provided and adjusted on a yearly basis reflecting an increment on the rate.

ROOM AMENITIES

Room with AC, telephone, color TV, hairdryer, iron & ironing board, alarm clock, coffee maker, and in room safe.

ROOM OCCUPANCY

Rooms can be occupied by a maximum of 3 people in the Junior Suites category, including children. We will charge the extra person from the third adult in the room. Children from 0 to 4 are free of charge; children from 5 to 12 will be the stipulated rate when sharing the room with 2 adults. Children over 13 are considered as adults. 

ACCOMMODATIONS

  • Junior Suite occupancy is for three persons or 2 adults and 2 children (until 12 years)

HOTEL POLICIES

  • Children 5 – 12 on the Breakfast rate plan will be charged the children’s contracted rate.
  • Children 13 years and older are considered an adult and will be charged the current adult Breakfast rate.
  • All guests are required to wear hotel issued wristbands for identification purposes throughout all hotel outlets and public areas. Additional guests (visitors to guestrooms) are required to identify themselves at the registration desk and will be charged an additional fee.
  • No pets allowed.
  • No parties or loud music allowed in guestrooms that disturb surrounding guests.
  • Check in:15:00 hours (local hotel time) / Check out: 12:00 hours (local hotel time) unless otherwise specified in the agreement.
  • All guests must agree to and adhere by Hotel Operator’s policies related to Spring Break upon check-in with proof of signature for Guests staying during Spring Break period.
  • Rate includes daily room cleaning once a day. Should you require any special cleaning service, there will be an extra charge.

AVAILABILITY

Tesoro Cabo San Lucas guarantees availability of Golio Room Allotment for 5 years’ subject to reservation being secured not less than 90 days prior to stay. All reservations need to be paid in full 30 days prior to the guest’s arrival providing proof of payment to the Reservations department. See Payment Procedures.

TERMS OF EXERCISABLE RIGHTS

Not less than 90 days prior to stay, hotel will receive reservation deposit.

UNAVAILABILITY & GUEST RELOCATION

In the event the room category contracted by GOLIOâ„¢ is not available when the client arrives to the Hotel Operator will take one of the following:

  1. Upgrade at same rate to a better room or rooms
  2. Relocate customer to a hotel of equal or higher value
  3. Prepay customers to other hotel for the room nights in question and include all transportation costs of customers to alternative accommodations
  4. Hotel Operator will submit an invoice to Golioâ„¢ for the number of nights of the original reservation to be paid at the contracted rates to Hotel Operator.

CANCELLATION & NO SHOW

All cancellations or rescheduled reservations should be made in writing and sent directly to the Hotel and Golioâ„¢.

COMPLAINT RESOLUTION

Should a mutual customer submit a letter of complaint to Golioâ„¢ after returning from their vacation, the letter will then be forwarded to the Hotel, Hotel agrees to respond back in writing to Golioâ„¢ no more than 7 business days after receiving complaint letter, Goliâ„¢o will recommend compensation to Hotel based on complaint for consideration by Hotel, if no response is received from Hotel on the 8th business day, Golioâ„¢ will subtract recommended compensations from future room night revenue.

INTERRUPTION OF HOTEL SERVICES (Restaurant or Pool Closures, Construction, etc.)

Hotel will update Golio’s inventory department at least 30 days prior to any interruption of hotel services. If within 30 days, as soon as interruption of services is identified, Golio™ will be notified. This would include events such as remodeling, pool closures, and restaurant closures, etc. If the closure(s) last longer than originally anticipated vendor will alert Golio™ with updates and completion of project well in advance of original completion date.

NAME CHANGE

Name changes on a reservation that has been reported will be permitted as long as one name on the reservation remains the same as when the original reservation was reported.

TERM & TERMINATION

  • The effective date of this agreement is upon the receipt and acknowledgement of the properly signed copy of the agreement by the hotel.
  • Rates related to this agreement in addition to being valid for the calendar year noted will remain in effect and available for sale until Golioâ„¢ is provided new rates for the coming year.

CONFIDENTIALITY

Neither party shall not, either during or after termination of this agreement, divulge or communicate to any third persons and of the secrets, confidential information or business affairs which either party may obtain during the currency of this agreement.

AUTHORITY

The person(s) signing this Agreement each warrant that they are authorized to bind the party for which they are signing. Any provision of this Agreement that is deemed unenforceable shall be ineffective to the extent of such unenforceability without invalidating or rendering the remainder of this agreement invalid. Each party shall execute such other and further documents as may be necessary to carry out the intention as well as to comply with the provision of this Agreement.

COMPLIANCE WITH LAWS

  • Guests shall comply with all Federal, State and local laws, rules and regulations with respect to its activities on Hotel property.

RIGHT OF INSPECTION/ ENTRY

Hotel will have the right to enter and inspect all rooms. If Hotel observes any illegal activity or activity that may result in harm to persons, objects or Hotel property, Hotel has the right to require guests to immediately vacate Hotel premises. In such event, Golioâ„¢ will remain liable for all fees and charges of guest stay pursuant to the terms of this Agreement.

FORCE MAJEURE

  • Force Majeure indicates fire, flood, explosion, hurricane, epidemic, earthquake, quarantine, embargo, or other acts of God, malfunction, damage or destruction to equipment or facilities, strike or other dispute with worker, riots or civil disputes, war, (whether declared or undeclared) armed conflict, terrorism acts, any municipal ordinance or provincial or federal law, governmental order or municipal ordinance, governmental order or regulation or order of any court or regulatory body, fraud, breaches of system security or any other event not within the reasonable control of the party which renders continued performance under this Agreement impossible, impractical, or illegal.
  • If at any time during the term of this agreement either party is unable to perform its obligations under this Agreement by reasons of the occurrence of an event of Force Majeure, that party will be excused from the performance of its obligations, during the continuance of such inability, provided that party provides written notice of the occurrence to the other party within three (3) days of its occurrence and takes all reasonable measures to prevent or remove the Force Majeure. Where an event of Force Majeure occurs at Hotel, Hotel will provide Golioâ„¢ with substitute accommodations, if possible, upon Golio’s request.

SEVERABILITY

The invalidity or unenforceability of any provision of this agreement will not affect the validity or enforceability of any other provision hereof and any such invalid or unenforceable provisions will be deemed to be severable.

COUNTERPARTS

This agreement may be executed in several counterparts at the same or different times and such counterparts as are so executed shall together form one original agreement and shall be read together and construed as if all the signing parties hereto had executed one copy of the agreement at the same time.

INDEMNITY

Each party shall indemnify, defend and hold harmless the other party, its affiliates, parent and their respective directors, officers, and employees (collectively, the “Indemnified Parties†and individually an “Indemnified Partyâ€) from and against any and all claims, damages, losses, costs and expenses of any kind arising out of or resulting from the Services provided by either party, including injury to or death of any person, damage, loss or destruction of any property, real or personal (including but not limited to property owned, leased or under the control of property). The indemnified party will promptly notify the indemnifying party of any claim made or suit brought within the scope of this Section.

GOVERNING LAW & LANGUAGE

This agreement shall be interpreted, enforced and governed according to the laws of the state of California, without regard to conflict of law statues or procedures.

The parties have required that this Agreement shall be drawn up in the English Language.

PAYMENT PROCEDURE

  • All reservations need to be paid in full 30 days prior to the guest’s arrival providing proof of payment to the Reservations department.
  • All reservations are on a prepayment basis only, unless credit has been applied for and approved by the hotel’s accounting department. Payments should be made via cashier’s check, bank transfer or deposit to the hotel’s account and copy of the transfer or deposit slip must be sent to Tesoro Resorts at the address provided. Please document the name of the Hotel on the check using the following format for each Hotel accordingly:
  • In order to guarantee the booking of the room a credit card number is required with the expiration date and cardholder name accepting all above mentioned details/policies. Payment need to be done a month prior to arrival.

ROOM CANCELLATIONS / NO SHOW

All employees from Golio will be able to cancel their Reservations following/applying the Season Chart mentioned below, by not following these conditions, Golio accepts the hotel will charge the penalty regarding any extraordinary cancellation and/or No Show (not presenting in the property on the day of the reservation) applying/ following the Season Chart.

RIGHT OF ADMISSION

In order to maintain a family atmosphere of respect and cordiality, the Hotel reserves the right of admission to guests that violate the code of conduct and decency that is stipulated by law and is required by the police and the Municipality of Cabo San Lucas.
